Agreement to Terms
By accessing or using Your Waitinglist ("Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
1. Service Description
Your Waitinglist provides an embeddable waitlist management platform that allows you ("Client," "you") to:
- Create and manage waitlist forms for your projects
- Collect verified email signups from your website visitors ("Subscribers")
- Customize form fields and welcome emails
- View subscriber analytics and manage subscriber data
- Export subscriber lists
- Integrate with third-party services (paid plans)
The Service is provided via a JavaScript snippet that you embed on your website.
2. Account Registration
2.1 Account Creation
- You must provide accurate, complete, and current information
- You must verify your email address
- You must be at least 18 years old
- You are responsible for maintaining the security of your account
3. Subscription Plans & Billing

Billing is processed through Stripe. You may upgrade, downgrade, or cancel anytime from your account settings.
4. Data Ownership & Privacy
4.1 Your Data Belongs to You
- You own all subscriber data collected through Your Waitinglist
- We act only as a data processor on your behalf
- We will never sell, rent, or trade your data or your subscribers' data to anyone
- We will never use your subscriber lists for our own marketing
- You can export and delete your data at any time
4.2 Your Responsibilities as Data Controller
You agree that you:
- Have a lawful basis to collect subscriber emails (consent, legitimate interest, or contract)
- Will comply with GDPR, CAN-SPAM, CASL, and all applicable privacy laws
- Will provide clear privacy notices to your subscribers
- Will honor subscriber rights (access, deletion, objection, etc.)
- Will not use the Service to send spam or unsolicited emails
5. Acceptable Use Policy
5.1 Prohibited Uses
You may NOT use the Service to:
- Send spam, unsolicited emails, or bulk commercial messages
- Collect emails without proper consent or legal basis
- Violate any privacy laws (GDPR, CAN-SPAM, CASL, etc.)
- Distribute malware, viruses, or malicious code
- Engage in phishing, fraud, or deceptive practices
- Circumvent plan limits or abuse the service
- Use the Service for illegal activities
6. Service Availability & Support
We strive for 99.9% uptime but do not guarantee it. Support is provided via email:
- Free plan: Email support, best-effort response
- Paid plans: Priority email support
- Scale plan: Dedicated support channel
7. Liability & Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
Maximum Liability: Our total liability is limited to the amount you paid us in the 12 months prior to the claim, or $100 (whichever is greater).
